WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT.
In consideration for 3 Steps Travel LLC (Company) receiving permission of to participate in the travel and tour planning services, you hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE Company, its officers, agents, servants, and/or employees from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you, or any of the property belonging to you, WHETHER CAUSED BY THE NEGLIGENCE OF COMPANY, or otherwise, while participating in such services, or while in, on, or upon the premises where the activity is being conducted.
You are fully aware of the risks involved and hazards connected to this travel activity, including but not limited to, travel risks. You hereby elect to voluntarily participate in said activity with full knowledge that said activity may be hazardous to you and your property. You VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by you, or any loss or damage to property owned by you, as a result of being engaged in such an activity, WHETHER CAUSED BY THE NEGLIGENCE OF COMPANY or otherwise.
You further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS the Company from any loss, liability, damage or costs, including court costs and attorney fees, that it may incur due to your participation in said activity, WHETHER CAUSED BY NEGLIGENCE OF COMPANY or otherwise.
You understand that Company does not maintain any medical or health insurance policies for students, teachers, and/or chaperones. As such, you are aware that you should review your personal insurance portfolio especially accident and/or medical coverage.
It is your express intent that this Agreement shall bind the members of your family and spouse, if you are alive, and your heirs, assigns, and personal representative, if you are deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE the above-named Company and its officers, agents, servants, and/or employees. You hereby further agree that this Agreement shall be construed in accordance with the laws of the State of North Carolina.
BY PURCHASING A TICKET FOR THIS TRAVEL EVENT, YOU ACKNOWLEDGE AND REPRESENT THAT you have read the foregoing Agreement, understand it, have had opportunity to review with legal counsel if desired, and AGREE voluntarily as your own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; you are at least eighteen (18) years of age and fully competent and you execute this Agreement for full, adequate, and complete consideration fully intending to be bound by the same.
If Participant is under the age of 18, Parent/Guardian consents to the minor’s participation in the TRAVEL AND TOUR PLANNING SERVICES AS set forth above and agrees to be bound by the terms of the Travel Waiver of Liability and Hold Harmless Agreement.
